Rubbish Collection Elephant and Castle Terms and Conditions
These Terms and Conditions set out the basis on which we provide rubbish collection and waste removal services in and around Elephant and Castle. By booking a service, you agree to be bound by these Terms and Conditions. Please read them carefully before placing a booking.
1. Definitions
In these Terms and Conditions, the following expressions have the meanings set out below:
Customer means the person, business, organisation or other entity who requests and/or pays for the waste collection service.
Service means any rubbish collection, waste removal, bulky item collection, or related service that we provide.
Waste means any rubbish, household waste, commercial waste, garden waste or other material that is agreed in advance to be collected as part of the Service.
Contract means the agreement between us and the Customer for the supply of the Service, incorporating these Terms and Conditions and any written quotation or confirmation.
2. Scope of Services
We provide rubbish collection and waste removal services within the defined service area that includes Elephant and Castle and certain surrounding locations. The exact scope of the Service will be as described in our quotation or booking confirmation.
Unless expressly agreed in writing, the Service is limited to the collection, loading, transportation and lawful disposal or recycling of agreed Waste from the agreed collection address. We do not undertake building works, dismantling of fixed structures, specialist cleaning or other services unless clearly stated.
We reserve the right to refuse any Waste which we consider unsafe to handle, not as described at the time of booking, or which we are not legally permitted to collect or transport.
3. Booking Process
3.1 Bookings can be made by telephone or email, or through any booking method we notify to you from time to time. A booking is an offer by you to purchase the Service subject to these Terms and Conditions.
3.2 We may request details including but not limited to: your name, contact information, collection address, access details, description and estimated volume or weight of the Waste, and preferred date and time window for collection.
3.3 We will provide an estimated price based on the information you supply. This estimate may change if the actual volume, weight, type of Waste or access conditions differ from those described at the time of booking.
3.4 Your booking is not confirmed until we have accepted it and, where applicable, received any required deposit or prepayment. We reserve the right to decline or cancel a booking at our discretion, for example where the Service cannot be safely or lawfully provided.
4. Access and Customer Responsibilities
4.1 You must ensure that our team has safe, reasonable and lawful access to the collection point at the agreed time. This includes arranging any necessary parking, loading access, entry codes, keys or permits.
4.2 You are responsible for ensuring that the Waste is clearly identified and is ready for collection. Unless agreed otherwise, our team is not required to sort through mixed materials, move items from upper floors without lift access, or disassemble large items.
4.3 If access is obstructed, unsafe, or significantly different from what you described at the time of booking, we may at our discretion: charge a waiting fee, vary the price, reschedule the Service, or treat the visit as a cancellation by you and apply the relevant cancellation charges.
4.4 You must not request our team to perform any task that is unsafe, unlawful, or outside the agreed scope of the Service. Our team members may decline any request that they reasonably believe could create a risk to health, safety or property.
5. Waste Types and Prohibited Materials
5.1 The Service covers general household waste, commercial waste and non-hazardous items that can lawfully be collected, transported and disposed of or recycled by a licensed carrier.
5.2 The following materials, without limitation, are considered restricted or prohibited unless we have explicitly agreed in writing to collect them: asbestos, chemicals, solvents, oils, clinical or medical waste, pressurised containers, gas bottles, explosives, flammable liquids, radioactive materials, and any other hazardous waste as defined under applicable UK law.
5.3 If, on arrival, we find that the Waste includes prohibited or hazardous materials that were not declared in advance, we may refuse to collect some or all of the Waste, adjust the price to reflect additional handling and disposal costs, or terminate the Service. You may also be charged for our attendance.
5.4 You warrant that all Waste presented for collection is your property or that you have the authority of the owner to dispose of it. You agree to indemnify us against any claim brought by a third party in relation to ownership of the Waste.
6. Pricing and Payment
6.1 Unless otherwise stated, all prices are quoted in pounds sterling and may be subject to applicable taxes and charges. We may quote on the basis of estimated volume, weight, labour time, access difficulty, and disposal costs.
6.2 The final price will be confirmed on site once our team has inspected the Waste and access conditions. If there is a material difference from the information provided at the time of booking, the price may increase or decrease accordingly.
6.3 Payment is due in full on or before completion of the Service, unless we have agreed alternative credit terms in writing. We may require a deposit or full prepayment to secure the booking.
6.4 We accept payment methods as notified to you at the time of booking. You must ensure that any card or account used for payment is yours or that you have authority to use it.
6.5 If payment is not received when due, we reserve the right to charge interest on overdue sums, suspend further services, and recover any reasonable costs incurred in pursuing late payment.
7. Cancellations and Amendments
7.1 You may cancel or amend a booking by contacting us using the details provided at the time of booking. Cancellations and amendments are effective only when acknowledged by us.
7.2 If you cancel more than 24 hours before the scheduled collection time, any prepayment may be refunded or transferred to a new booking at our discretion, less any reasonable administrative costs.
7.3 If you cancel within 24 hours of the scheduled collection time, or if we attend the address and are unable to complete the Service due to your act or omission, we may charge a cancellation fee up to the full quoted price to cover our costs.
7.4 We may cancel or reschedule the Service if affected by events beyond our reasonable control, including but not limited to severe weather, transport disruption, staff illness, accidents, or changes in legal requirements. In such cases, we will aim to notify you as soon as reasonably possible and offer an alternative date or a refund of any prepayment for services not provided.
8. Service Delivery and Performance
8.1 We will use reasonable care and skill in providing the Service and will endeavour to carry out collections within the agreed time window. However, any time stated for arrival or completion is an estimate only and is not guaranteed.
8.2 We are not liable for delays caused by traffic, parking difficulties, access issues, weather, or other circumstances outside our reasonable control. In these situations, we will take reasonable steps to keep you informed and to rearrange where necessary.
8.3 Once the Waste has been loaded into our vehicle, it becomes our responsibility and we will arrange for its lawful disposal or recycling in accordance with applicable waste regulations.
9. Liability and Damage
9.1 Nothing in these Terms and Conditions limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded under UK law.
9.2 Subject to the above, we will not be liable for any loss or damage that is not reasonably foreseeable, or for any loss of profits, business, revenue, contracts or anticipated savings, or any indirect or consequential loss or damage.
9.3 You are responsible for protecting your property, including floors, walls, fixtures and fittings, and for removing any valuables or fragile items from the vicinity of the collection route. We will take reasonable care but are not liable for normal wear and tear or minor cosmetic damage that may occur in the course of moving large or heavy items.
9.4 If we damage your property due to our negligence, you must notify us in writing as soon as reasonably practicable and in any event within 7 days of the Service. Our liability will, at our option, be limited to repairing the damage, arranging a repair, or paying the reasonable cost of repair or replacement, taking into account age and condition.
9.5 Our total liability to you arising under or in connection with the Contract, whether in contract, tort, negligence or otherwise, shall be limited to the total amount paid or payable by you for the relevant Service.
10. Compliance with Waste Regulations
10.1 We operate as a licensed waste carrier and will handle, transport and dispose of Waste in accordance with applicable UK legislation and regulations relating to waste management.
10.2 We may keep records of collections and disposals as required by law, including details of the origin, type and quantity of Waste, and the facilities used for treatment, recycling or disposal.
10.3 You agree not to request or encourage any action that would result in unlawful dumping, fly-tipping or other breaches of waste regulations. We reserve the right to terminate the Service and report any suspected unlawful activity to the relevant authorities.
10.4 Where we provide any documentation relating to the transfer or disposal of Waste, you should retain this for your own records and for any compliance obligations that may apply to you.
11. Customer Data and Communications
11.1 We may collect and store information about you and your bookings to manage the Service, process payments, and comply with legal or regulatory requirements.
11.2 Your contact details may be used to communicate with you about bookings, changes to the Service, or important information relating to your Contract. We may also use your details, where permitted, to inform you about related services that may be of interest, and you may opt out of such communications at any time.
12. Complaints
12.1 If you are dissatisfied with any aspect of the Service, you should contact us as soon as possible with details of your concern. We will investigate and aim to respond within a reasonable time.
12.2 Raising a complaint does not entitle you to withhold payment for services properly provided, unless we expressly agree otherwise in writing.
13. Variations to These Terms
13.1 We may update or amend these Terms and Conditions from time to time. The version in force at the time of your booking will apply to your Contract.
13.2 Any variations to these Terms and Conditions requested by you will only be effective if agreed in writing by us.
14. Severability
14.1 If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable by a court or other competent authority, that provision will be deemed deleted, and the remaining provisions will continue in full force and effect.
15. Governing Law and Jurisdiction
15.1 These Terms and Conditions and any dispute or claim arising out of or in connection with them or their subject matter or formation, whether contractual or non-contractual, shall be governed by and construed in accordance with the laws of England and Wales.
15.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Service provided.
16. Entire Agreement
16.1 These Terms and Conditions, together with any written quotation or booking confirmation, constitute the entire agreement between you and us in relation to the Service and supersede any prior understandings, agreements or representations, whether oral or written.
16.2 You acknowledge that you have not relied on any statement, promise or representation that is not expressly set out in these Terms and Conditions.
